These Terms of Service ("Terms") govern your access to and use of benjaminsonfire.com (the "Site") and any digital products or subscriptions purchased through it ("Products"). The Site is operated by an individual sole trader based in Australia ("we," "us," "our"). By using the Site or purchasing any Product, you agree to these Terms.
All content on this Site and in the Products is provided for educational and informational purposes only. Nothing on this Site or in any Product is, or should be construed as, financial, investment, tax, legal, or accounting advice. We are not a licensed financial advisor, broker, dealer, or investment adviser in any jurisdiction, and we are not acting in a fiduciary capacity for you.
The portfolios, positions, weights, theses, and rules described in the Products reflect one individual's personal views and trading activity as of the date of publication. They may be changed or closed out at any time without notice. You are solely responsible for any decision you make as a result of reading the Products.
All trading and investing involves risk, including the total loss of capital. Past performance is not indicative of future results. We make no representation or warranty that any position, portfolio, thesis, or rule described in a Product will produce any specific result for you or anyone else. You must do your own research and, if needed, consult a licensed professional in your jurisdiction before making any investment decision.
On successful payment, we grant you a non-exclusive, non-transferable, worldwide licence to download, read, and use the purchased Product for your personal, non-commercial use. You may not:

The Live weekly update is a subscription billed monthly or annually via Stripe. Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time using the link in any Live email or by contacting us at hello@benjaminsonfire.com. Cancellation stops future renewals; it does not entitle you to a refund of the current period.
Payments are processed by Stripe. All prices are displayed in US dollars and charged in USD. You are responsible for any applicable taxes, duties, bank fees, or foreign-exchange charges that apply to your purchase in your jurisdiction.
Digital products are delivered immediately after successful payment via a download link on this Site and by email. If you do not receive your link within 15 minutes, email hello@benjaminsonfire.com and we will resend it.

You agree not to (a) attempt to circumvent the paywall or share download links with others, (b) attempt to reverse engineer, scrape, or republish the Site, (c) use the Site or Products for any unlawful purpose, or (d) impersonate any person in communicating with us.
To the maximum extent permitted by law, we are not liable to you for any indirect, incidental, consequential, or special damages arising from your use of the Site or Products, including but not limited to lost profits, trading losses, or loss of data. Our aggregate liability to you in respect of any and all claims arising out of or in connection with the Site or Products is capped at the amount you actually paid us in the twelve months preceding the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable consumer-protection legislation, including the Australian Consumer Law.
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any dispute arising out of these Terms.
We may update these Terms from time to time. The "last updated" date at the top will reflect the current version. Continuing to use the Site after a change constitutes acceptance of the new Terms.
